Agreement & Acceptance

These Terms constitute a legally binding agreement between you and Global Email Lists governing your access to and use of the Website and all associated Services, including but not limited to B2B email lists, mailing databases, industry data lists, data append services, and any related products offered on the Website.

By (a) placing an order, (b) downloading or accessing any data file, (c) creating an account, or (d) otherwise using our Services, you acknowledge that you have read, understood, and unconditionally agree to these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

These Terms apply to all visitors, clients, and others who access or use the Services. Any supplementary agreements, order forms, or statements of work executed between you and Global Email Lists shall be incorporated herein by reference and shall form part of this agreement.

Eligibility & Account

To access and purchase our Services, you must:

• Be at least 18 years of age and legally capable of entering into binding contracts;
• Represent a legitimate business entity engaged in lawful commercial activities;
• Provide true, accurate, current, and complete information during registration or purchase; and
• Maintain and promptly update your account information to keep it accurate and current.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at info@globalemaillists.com of any unauthorized use of your account or any other breach of security. Global Email Lists will not be liable for any losses resulting from unauthorized use of your account.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including where we believe a client’s intended use of the data may violate applicable laws or these Terms.

License Grant & Permitted Use

Subject to your compliance with these Terms and payment of all applicable fees, Global Email Lists grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the purchased data and Services solely for your own internal, legitimate business marketing and communications purposes during the applicable license term.

Permitted uses of the data include:

• Sending targeted B2B marketing emails, newsletters, or promotional communications to identified prospects;
• Direct mail campaigns and postal outreach;
• Telemarketing outreach to business contacts where permitted by law;
• Internal lead generation, sales prospecting, and CRM enrichment; and

The license is strictly limited to the number of records, territories, and use-cases specified in your purchase order. All rights not expressly granted herein are reserved by Global Email Lists.

Prohibited Activities

You expressly agree that you will not, under any circumstances:

• Resell, sublicense, transfer, distribute, or otherwise make the purchased data or Services available to any third party without our prior written consent;
• Use the data for consumer credit decisions, insurance underwriting, employment screening, tenant screening, or any purpose governed by the Fair Credit Reporting Act (FCRA) or equivalent statutes;
• Use the data to send spam, unsolicited bulk emails, or communications that violate the CAN-SPAM Act, CASL, GDPR, or any other applicable anti-spam or data-protection legislation;
• Use the data to contact individuals who have opted out or unsubscribed from communications, or whose names appear on applicable Do-Not-Contact or Do-Not-Call registries;
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source structure of the database or any proprietary systems;
• Combine or co-mingle our data with data from other providers to create derivative lists for resale without prior written consent;
• Use the data to create, distribute, or promote pornographic, discriminatory, fraudulent, abusive, or otherwise unlawful content;
• Attempt to probe, scan, or test the vulnerability of our systems, networks, or Website;
• Introduce any viruses, malware, spyware, ransomware, or other malicious code into our systems;
• Use automated bots, scrapers, or data extraction tools on the Website without express written authorization; or
• Use the data in any manner that violates applicable federal, state, local, or international laws or regulations.

Important: Any violation of these restrictions may result in immediate suspension of your access, termination of your account, forfeiture of fees paid, and potential legal action.

Data Quality & Accuracy

Global Email Lists maintains a master database of over 30 million business contacts and employs rigorous verification processes, including regular data hygiene, opt-in validation, and multi-source cross-referencing, to ensure high levels of accuracy and deliverability. Our team continuously updates the database to reflect changes in business information, email addresses, and contact details.

However, data accuracy cannot be guaranteed at 100% due to the inherently dynamic nature of business contact information. We offer the following data quality commitments:

• Email Deliverability Guarantee: We guarantee a minimum deliverability rate on purchased email lists as specified in your order confirmation. If deliverability falls below the guaranteed threshold due to data quality issues attributable to us (and not factors within your control, such as email sender reputation), we will replace undeliverable records at no additional charge.
• Data Freshness: Our databases are regularly updated, and we indicate data verification dates on our product listings where applicable.

You acknowledge that the data is provided for business-to-business (B2B) marketing purposes only. You are solely responsible for independently verifying data accuracy and compliance with any specific regulatory requirements applicable to your industry or jurisdiction before use.

Payment & Refund Policy

All fees for our Services are as stated at the time of purchase. Payment is due in full before delivery of data unless otherwise specified in a separate written agreement. We accept major credit cards, wire transfers, and other payment methods as indicated on the Website.

Regarding refunds:

• Due to the digital nature of our products, all sales are generally final once data has been delivered to you.
• Refund or replacement requests related to data quality may be submitted within 30 days of delivery. Requests must include documentation (e.g., bounce reports) demonstrating that deliverability or accuracy fell below the guaranteed thresholds specified in your order.
• Approved refund or replacement requests will be processed within 10 business days.
• Refunds will not be issued for data that has already been used in marketing campaigns or processed into your systems.
• Customized or bespoke data orders are non-refundable once the data has been compiled and delivered.

Intellectual Property

Global Email Lists retains all right, title, and interest in and to the Services, the Website, and the underlying data, databases, software, methodologies, trademarks, trade names, logos, and all related intellectual property rights (collectively, “IP”). The data you purchase is licensed, not sold. You may not claim ownership over any portion of our database or brand the data as your own proprietary asset.

All content on the Website — including text, graphics, logos, button icons, images, and software — is the property of Global Email Lists and is protected by applicable copyright, trademark, and other intellectual property laws. We reserve the right to terminate your account immediately and without refund if we determine, in our sole discretion, that your use of the data violates any law or these Terms.

Privacy & Data Protection

Global Email Lists is committed to protecting privacy and handling personal data responsibly. Our data collection, storage, and processing practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

In relation to the B2B data we provide:

• Our database consists of business contact information sourced from publicly available records, opt-in directories, trade publications, and other legitimate B2B data sources.
• Each marketing communication sent using our data must include a clearly visible and functional unsubscribe mechanism, your company’s full postal address, and a link to your privacy policy.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, Global Email Lists expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. Global Email Lists does not warrant that the services will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected. No oral or written information or advice given by Global Email Lists or its representatives shall create a warranty not expressly stated in these terms.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Global Email Lists, its directors, officers, employees, agents, partners, or suppliers be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages whatsoever, including but not limited to loss of profits, loss of revenue, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of or inability to use the services or data, even if Global Email Lists has been advised of the possibility of such damages.

In no event shall Global Email Lists’ total cumulative liability to you for all claims arising out of or relating to these terms or the services exceed the total amount paid by you to Global Email Lists for the specific service giving rise to such liability in the three (3) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Global Email Lists and its directors, officers, employees, agents, affiliates, licensors, and service providers from and against all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

Term & Termination

Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law principles.

You agree to submit to the exclusive jurisdiction of the state and federal courts located in Washington County, Oregon, for the resolution of any disputes arising out of or relating to these Terms or the Services. You waive any objection to the laying of venue of any such proceedings in those courts and waive any objection that such proceedings have been brought in an inconvenient forum.

Notwithstanding the foregoing, Global Email Lists reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or halt any actual or threatened infringement of its intellectual property rights or breach of confidentiality obligations.

Modifications to Terms
